The International Abduction of Children is a very serious offense and not taken lightly by the American Courts. The Hague Convention was designed to address this exact issue. You must first check to see if your country is a signatory to the Hague Convention. If it is the process is clesrly spelled out. The State Court in which your child is now residing will have to make an initial determination of the child's country of "habitual residence". Once that determination is made, the court in which the custody hearing will be determined becomes more clear. YOU MUST be aggressive in this effort. Without YOUR application to the American court in intervene under the rules of the Hague Convention, there is little or nothing the courts here will be able to do.
