QUESTION

How can I quickly modify my divorce decree?

Asked on Nov 26th, 2018 on Divorce - Iowa
More details to this question:
Our decree states that we owe each other half of our retirement at the time of divorce. We both agree that we want to eliminate this and each keep our own. I am getting ready to retire very soon and I need to make this legal.

Unfortunately, the court does not have the jurisdiction or ability to modify a divorce decree's provisions about division of property (money).  If there were never any QDROs filed (to split the retirement funds), then they will not be split and you will be paid all of your retirement.  If the decree reads that you each owe the other some amount, you could file satisfactions of judgment to resolve that issue.     Donna Miller http://donnamiller-law.com/
