QUESTION
How can I receive custody of my 2 month cousin his mom is on drugs and currently placed by the state at my aunts where i live. I just want him safe.

I live with aunt and her daughter just had her 3rd baby while on hard core street drugs. She was kicked out of my aunts house after failing to stay clear of drugs and shooting up in front of her 6 yr old son. She just had a baby and he currently 2 months i have been taking care of him since he was placed here by children services. My boyfriend and I are looking take full custody over him by the time he is 6 months. The only thing is his father is getting out of jail in August and I don’t want my little cousin to fall into the wrong hands and grow up like my boyfriend did. I truly don’t know what to do and need help. My aunt has already told me with confidence she wants me to have him as she already has his other 2 siblings and is almost in her 60’s.

While you cannot gain guardianship without parental rights being voluntarily or involuntarily terminated, the parents may be willing to sign a Temporary Power of Attorney for Our Minor Child allowing you to take care of the child, take him to the doctor, enroll him in school, etc. This can be revoked. But once you have cared for the child for six months without either parent trying to see him, you can ask CPS to grant you custody.
