QUESTION

How can I separate from spouse?

Asked on Aug 27th, 2012 on Divorce - Georgia
More details to this question:
My spouse has turned lazy and verbally abusive. I have no money since he built a company (that I helped him build) and now the company is paying him. We have two small children. How can I separate from him for a period of time? What do I need to do to ensure he doesn't claim I took the kids? Should I ask him if he wants to keep them? He is also mean to the kids and does not spend any time with them, so I would not want to leave them with him. I do everything from the kids and the household. My limitation is lack of funds, but out of self respect, I must remove myself from the situation that is also not fair for the kids.

Your question raises alot of issues.  I highly recommend that you consult with an attorney.  If your husband is the bread-winner of your family, a divorce attorney can help you to obtain temporary support so that you can afford to take care of yourself, your children and attorney fees.  This can be accomplished through a petition for separate maintenance or divorce.
