How do i avoid child support

More details to this question:
i have been supporting my child since her birth in 2011 after me and her mother separated. In December i have not sent her mother any money so that i can afford gifts for my daughter. I was just served with paper for child support yesterday. and i am currently unemployed. I understand that it is based on you most recent tax returns but i have not yet file because am waiting for my W2 form my work in 2013 and i have court on feb 5th. I am worries i would not be able to pay

You cannot avoid child support. However, you don't have to file your taxes, but you can bring the W-2 and your last three paycheck stubs with you to court on Feb. 5. If you are on unemployment, bring proof of that. Fill out the court's financial statement form (it should have been given to you, but you can find it on the Family Court's website). Once you get to court, if you feel like you aren't ready or the mother has a lawyer, you can ask the court for more time to find a lawyer. The court might set a temporary amount until a hearing can be held, giving some more time for you to get your W-2 and provide financial information.
