QUESTION

How do I begin this divorce process without any money?

Asked on May 14th, 2015 on Divorce - Oklahoma
More details to this question:
How do I find out the steps that I need to take to start the divorce? Husband is the one that is wanting the divorce but he has not filed yet. Do I need to do that or wait for him? I have no income or even a bank account for myself. It's been almost 5 years since I've worked due to my many health issues. I am currently being cared for by multiple physicians to try to improve my health. I hope to get well enough at some point to be able to get back to working. My husband wants me to leave our home as well as leave our only car (he drives a work vehicle during the week) but I have nowhere to go and do not have any family to turn to. What are my rights or options? Please help me with these questions, any advice would be very appreciated. Thank you for your time.

You can try Legal Aid Services in your area. Also, some law schools or religious charities may have some legal clinics. If not, you can go to a law library and ask for some form books to try on your own. You would have to look for forms that include the petition, summons, temporary relief, and for filing with a pauper's affidavit, among other documents; for samples of what is needed to file. If you wait for your spouse to file, then you may be able to have some relief of the filing fees.

You are ill, unemployed and have no independent means of support. Contact the Legal Aid office that provides services in your county. Share your information with them, including he has suggested he wants you to hit the bricks with no home, no car, and no support.
