QUESTION

How do I cancel a custody case I already opened?

Asked on Feb 09th, 2014 on Child Custody - Rhode Island
More details to this question:
I filed papers for custody of my daughter last week. The respondent has not been served yet. Can I still withdraw my petition for custody? There is a mediation date set and a court date set in the future. I filed the paperwork, but the county is the petitioner, my child's father is the respondent, and I am the "Other Parent" on the court paperwork.

"Papers for Custody" is not a legal action. I don't know what you filed since a single mother has custody of the child prior to any action to establish the father as a legal father. If the state filed (the county can not file) it is because you receive some kind of government benefit and the state is entitled to pay itself back from the child support the father should be paying. It sounds like the state and not you filed the action so you can't strike it.
