More details to this question:
I bought my mother's house from her-she maintains a life interest in it. My bother's widow and son live there and will not move. At my mother's death,am I obligated to continue this situation or can I legally sell the house as I wish to do? There is no written agreement to the sister-in-law living there.
Dear Anonymous,
The Life Estate extends only to your mother. Absent another agreement your brother's widow and son are tenants. They have rights as tenants, but not as owners. If you have any additional questions, do not hesitate to contact my office.
