How do I drop a no contact order

Asked on Jan 04th, 2019 on Domestic Violence - Florida
More details to this question:
I received a domestic violence charge and then a no contact order however my husband does not want the no contact order seeing as it was a mistake and huge misunderstanding, he is my husband father of my child I live with him he's the only family I have right now I cannot go home and I need to find out what papers I need to file and who has to come down here and do it because the state attorney's office is telling him the victim that I the defendant have to come down and file myself for a motion to dismiss trial and a motion to lift a no contact order however I don't understand how I'm supposed to do that if I'm the defendant I can't drop my own no contact order correct? Also I don't have an ID in order to file these things don't I need an ID? Who can I talk to you that will give me all this information I've been to the courtho and each time they told me something different he's called victims assistance and State attorney's office and they told him I have to come down and file this

Unfortunately, in a criminal matter, the state is the Plaintiff, and your husband is the "victim".  Depending on the county, if your husband puts in writing that he does not want to proceed with the charges, it basically leaves the state with no victim or witness, and sometimes they will drop the charges.    You should get a criminal attorney to handle this for you.  It should not be too involved, if your husband continues to wish to drop the charges, and it is worth the investment to get this taken care of.   Best of luck, Cindy S.
