We are Florida residents on driver's licenses because of military status, living there for 8 years and then transferred to Washington DC for his military assignment living in Stafford, VA for 2 months shy of 2 years. Spouse wants a divorce as of this week. Do we have to file in Virginia or can we file in Florida? I will be moving back to Florida next week.
If you have lived in Virginia for a period in excess of 6 months, you are eligible to file in Virginia. If you are returning to Florida, and wish to file in that jurisdiction, I suggest that you speak with a Florida attorney to discuss rules governing residents and domiciliaries of that state. If he remains in Va it may be quicker to file in Va, since you have both been domiciled in Va for a period in excess of a month.
