The father of my child is refusing to let me take our son with me to Texas. We had agreed that the child would stay with me in Guinea and he would visit. He told me to send the baby to him in NY for vacation and kept the baby against my will. I was able to get a visa and I am currently in NY. I have tried to reason with him about the baby being to young and the care I can provide him in Houston. He refuses to let me take the baby and would rather use a baby sitter. He works at night and uses a baby sitter that comes over at night which I am not comfortable with at all. How do I go about having legal custody of my son and taking him with me to Houston?

If the child has been here for more than 6 months, you may be stuck with New York as the child's home state. This means you can file a petition for custody here and ask the court to let you relocate. You should do so right away, especially if he isn't letting you see the child.
