QUESTION

How do I get her to take her possessions?

Asked on Sep 23rd, 2016 on Divorce - Illinois
More details to this question:
She left 4/8/16, filed for divorce 8/12/16 and I was served the summons 9/22/16. I have made repeated attempts by mail, hand delivered and certified mail to ask her to remove her possessions (she won't accept certified mail). I'd like to get her stuff out ASAP as she's demanding the house to be sold immediately in the petition but everything of hers and the grandkids are in the way. Also note this started over a domestic violence charge and order of protection against her so truthfully I don't want her in the house without the police present! How can I expedite this?

You will not get anywhere except through the court. Until the disposition of the house is determined, you probably have no right to demand she remove her possessions. She has the right to keep them there until what is happening to the house is ruled upon by the court. If there is a OP against her she cannot come into the house.
