How do I get spousal support and alimony?

More details to this question:
I needed to find out some advice on my divorce situation. I was married but my husband and I lived in another state. He left me in December of 2012 and moved with his parents. I lost my home and all my belongings because of him. I wanted to find out about spousal support or alimony laws. I am unsure which state do I have to go through. He also has warrants because of the DUIs he had gotten. He didn't pay on his fines. I have two children also. They are 15 and 13. He is not their biological father but he was there to help support them and raise them. I am just so lost and I do not know the laws or where I start. Thank you for your time. I appreciate any help you can give me.

Go to your local Family Division and ask at the walk in desk. In PA there is jurisdiction to file if you have 6 months of residency. Don't think you can get child support for children that are not his. Spousal support is a possibility if he has a good income.

Spousal Support and alimony are the same thing, the analysis the Court does is need, ability to pay, and length of the marriage. Each case is different. Use of a lawyer is recommended.

You start by sitting down for a consultation with an attorney where you are, and discussing the specifics of your situation with them. They will then be in a position, most likely, to give you input on which jurisdiction would be the one in which you have to file your divorce. They can also discuss alimony and answer your other divorce-relate questions, and discuss your options.

I understand your situation. Unfortunately you will not be able to receive child support for children which are not your spouse?s ?biological? children. Whether or not you are entitled to receive alimony will depend upon (1) the length of your marriage, (2) your financial situation as determined by your Financial Affidavit, and (3) your spouses financial situation as determined by his Financial Affidavit. You can file your case within the jurisdiction in which you are a resident regardless of where your spouse now resides. Good luck.
