QUESTION

How do I go about pursuing a perjury charges?

Asked on Feb 14th, 2014 on Divorce - Idaho
More details to this question:
I would like to pursue a perjury charge against my ex domestic partner that placed a protection order on me and failed to show for the trial. I was able to account for all my whereabouts and prove her allegations of stalking were false. In a few of her statements she claims to have actually seen me which I proved false. How can I charge her with perjury so she stops making false accusations against me?

You can bring your evidence to the district attorney. It is up to them to press charges. They are probably overloaded and won't get involved. You may also think about filing in family court for sanctions under Family Code section 271.

I suppose you could sue her for it, although I don't know if perjury is the basis for a private right of action. On the other hand, you may very likely have an abuse of process claim against her. Contact a local attorney and see if it actually would be worth while. If she doesn't have any money, it may not be worth it.

A perjury charge would come from DA's office. You can present the evidence to the District Attorney, but it is up to them to prosecute it.
