How do I move out of state with my child?

All relocation matters are governed by Florida Statute Chapter 61.13001.  I recommend you find it online and read it carefully. You could try to get the father to sign an agreement allowing you to relocate and follow that up with a court order approving your agreement.     If that does not work, you would need to file a Petition for Relocation and have the father served (it would also likely be a good time to file a Motion for Contempt for non-payment of child support). If he does not file an answer, then you should have little trouble getting an order for relocation from the court.  If he objects to the relocation and properly answers your petition, you will likely end up in mediation to try to resolve your case.  If mediation fails, you will end up in a trial before the Judge presenting your evidence and asking him/her to rule in your favor.  I hope this information was helpful.  My office offers 1 to 1.5 hour initial consultations for $200 or $350, depending on who you meet with, if you think you would like to get more in-depth about your case.  If you hire an attorney, you would need to find one who practices in your venue/county.  My office practices in Orange, Seminole, Osceola, Volusia and Lake Counties.  Best of luck.  Jennifer Frank
