I want to move out of state and bring my 3 year old with me. I have custody of her and have since she was born. Father comes around as pleased. No mediation, No child support.
All relocation matters are governed by Florida Statute Chapter 61.13001. I recommend you find it online and read it carefully.
You could try to get the father to sign an agreement allowing you to relocate and follow that up with a court order approving your agreement.
If that does not work, you would need to file a Petition for Relocation and have the father served (it would also likely be a good time to file a Motion for Contempt for non-payment of child support). If he does not file an answer, then you should have little trouble getting an order for relocation from the court. If he objects to the relocation and properly answers your petition, you will likely end up in mediation to try to resolve your case. If mediation fails, you will end up in a trial before the Judge presenting your evidence and asking him/her to rule in your favor.
