QUESTION

How do I prepare for a difficult custody battle?

Asked on Mar 09th, 2017 on Child Custody - California
More details to this question:
I am planning to file for separation. The custody of the children will be the most difficult process in the division. How do I prepare for a custody hearing when I don't believe my husband is fit to care for the children 50% of the time, but the reasons I believe he is not a fit parent are hard to prove? For example, when the kids are in his care, he does not take care of their basic needs, such as feeding them meals or changing diapers. Or something I see as more severe, he brought guns into the house without conferring with me, refused to get a safe for them until he found our then 1 year old about to put a loose bullet in her mouth, and he often brings them out needlessly. Or else, something in between, he drives recklessly with the kids in the car when he's experiencing road rage. I have stayed in this marriage to protect my children and because I have concerns about their and my safety.

Preparing for a custody battle is done the right way the first time or you risk losing a significant amount of time with the children for the rest of their minority. Although custody and visitation is ALWAYS modifiable, if you start of on ?the wrong foot? there is no way to go back. When you are dealing with children in court, competent legal representation should always be sought, as the subject matter of the litigation is so very important. One mistake here could cause the biggest adverse consequence of your life!
