You both need to file a document with the court stating that you are living together and the need for child support no longer exists.

Either make a motion to the court or if your support goes through DCS send them a letter stating that you have reunited and that the transfer payment should therefore cease.

If the order came from child support enforcement, you should contact that office and inform them you are reconciling. If the order for support came from the court system, you should file a motion to terminate the action and the child support order.

Go to the court and advise them you are residing together and, as long as that continues, you both would prefer the support obligation be suspended. Do not give up any arrearage, and understand that the state will not if there was assistance involved. Good luck!

FOR WEST VIRGINIA ONLY: The child support obligor, in this case the father, may file a petition for modification of child support with the clerk of the circuit court; otherwise, the Bureau for Child Support Enforcement will continue to order withholding of the court ordered child support obligation from his wages.
