QUESTION

How do I request for default divorce?

Asked on Mar 31st, 2014 on Divorce - Pennsylvania
More details to this question:
I filed for divorce with an attorney 6 months ago. Wife has still not signed though she has been served 6 months ago. Nothing has been finalized since attorney does nothing. I have attended parenting class, wife has NOT, she does not have an attorney and has been arrested 5 times since I filed. I thought if one had an attorney, everything would work out fine. I have already paid out $3000 to the firm.

I would suggest you telephone your attorney and tell him if he doesn't want to go forward with your case, he can send you a refund and you will get another attorney. If you are given the run-a-round, I suggest you file a complaint with the Florida Bar Association.

She doesn't have to sign anything. If she was properly served that's the end of your responsibility toward her. Where are the children? Have you made a motion for temporary orders to get a temporary child support order and parenting plan? If your lawyer hasn't done that, maybe you need a more active lawyer.

It depends . If you were separated for two years or more in Pa you may be able to get a divorce rather quickly assuming there are no other issues like property. If not you will have to wait the two years and then she can be forced into a property hearing and once that is done the decree will be signed unless she appeals. I would get another attorney.
