How do we go about starting stepfather adoption process?

More details to this question:
My husband would like to adopt our 5 year old daughter. We currently live in Texas but her biological father is not on her birth certificate and is currently incarcerated in California for involuntary manslaughter. My question what exactly do I need to do to start this process? Should I get a lawyer? Do I send him the consent to terminate parental rights form myself or does that go through the court? How will it work if he refuses to sign?

Yes you will need a lawyer. His rights can be terminated voluntarily by him signing an affidavit prepared by the attorney. If he refuses to sign his rights can be terminated due to his failure to register his paternity with the state paternity registry. That is the easiest way, but there are other ways too. A social study by a court approved social worker is also a prerequisite to the adoption. The process should take about two months.
