How does a custody agreement work if visitation is between school hours?

More details to this question:
My custody agreement says my daughter goes with her father on her birthday from 9 am till 5 pm and she has school from 8 am till 3 pm. How does this work when the visitation is between school hours. Would he just see her from 3 til 5 pm then?

Unless she is below 1st grade, no court will allow him to take her out of school. IT is an example of poor drafting. You should either reach an agreement to give him a different extra time such as after school through 7 or 8 pm, or if you can not reach an agreement, file a motion to modify - if you have joint custody m you should ask him to mediate the issue.
