QUESTION

How does he get the child support dropped?

Asked on Aug 18th, 2014 on Child Custody - Illinois
More details to this question:
I have a question about child support. My boyfriend has been paying child support for about 7 years. His divorce papers state that he has to pay until the children are 18 or has graduated. His oldest turned 18 in November 2013 but didn't graduate until May of this year. He has continued to pay these past 3 months and now the mother wants him to help pay for college. He has agreed to. He doesn't want to argue or have to go back to court. Thanks!

You can not make him do what he is unwilling to do. It may well be that his college contribution would be more than his child support payment. Depending on the county and the judge, the amount he would be ordered to pay toward college varies widely. His child support obligation did not end until May of this year, even though his child turned 18 last November. The only way he gets his support dropped is by going to court, unless the support order had a termination date. Even with a termination date many employers want the protection of a formal court order terminating support,
