QUESTION

How does one start the process to remove a biased arbitrator?

Asked on Jan 26th, 2015 on Child Custody - Washington
More details to this question:
The arbitrator ruled on child support matters that were outside his scope and powers. Truly bizarre especially as I had to keep writing reconsideration after reconsideration to get him to rule within his scope. I brought up much evidence, documents and emails that showed my ex manipulating and lying to create conflict, but this arbitrator enabled my ex to bully and harass me to no end with his rulings. The biggest frustration is that he is ruling to allow breeding grounds for conflict and harassment. As a result, my children and I continue to suffer. Please advise.

What is outside his "scope and powers?" If his decision ended in a child support order than he was within his power. Credibility of a party or witness is within his power to determine. What evidence he weighs most heavily is also within his powers. I think you need to have a lawyer review the decision to determine if indeed, the arbitrator did anything wrong or you just don't agree with the decision.
