QUESTION

How does someone reverse a name change after a divorce?

Asked on Jan 12th, 2014 on Divorce - New Jersey
More details to this question:
My mother went through a divorce without realizing that her name would change. She did not want to change her name to her maiden name. She would like to keep the name she has been using for the past 20 years. The divorce has already gone through the courts. And one more question: How long can she use her married name without changing any documents (Id's, passports, and such)?

I'm not sure how the name change could have occurred without your mother knowing because its usually something that you specifically have to ask the court to include.  You can always ask to amend the judgement of divorce to allow her to keep her name.  Usually when someone resumes using her maiden name, they use the judgement of divorce as proof that they are changing the name back.  if your mother wants to keep all of her things in the same name she has had, she just won't take that affirmative step of changing things.
