How long before I can have sole custody?

More details to this question:
My Son's mother was recently sentenced to 2 years in jail and she has other charges that could possibly be brought up which would make her stay longer. How long would it take for me to get sole custody?

You do not tell us whether you were married to the child's mother at the time the child was born, or whether you have been legally determined to be the father of the child. If there is a Court Order tat grants custody of the child to the mother, you might be able to file a Motion to Modify that Order. If there is no such Order then you might be able to file a suit seeking a determination of paternity and an award of custody. These things take anywhere from several weeks to several months. I would advise you to consult with and hire an attorney.
