How much does an uncontested divorce usually cost and how long will it take?

Is it easy for someone go through an uncontested divorce by themselves? How much would it cost to have a lawyer do it?

The answer depends on what the issues are. For instance, if there is a business that needs to be valued that would be a greater amount. If you are talking about a divorce where both of the parties are in total agreement on everything, it should cost approximately $1,000.00. The waiting period is 60 days from service to the time a decree can be entered.

An uncontested divorce, to do it right, will generally cost around $1500. It is not easy to do correctly without counsel. Given the fact it is the rest of your life you are dealing with I would suggest the investment in an attorney.

Every lawyer sets his or her own fees. Also, some divorces begin apparently 'uncontested,' and before the end the spouses are fighting over the houseplants. (This is not frequent, but is a recognize occurrence.) Figure that an experienced lawyer charges in the vicinity of $2,500 as an advance payment which may or may not be the total legal fee. Filing fee is either $184.50 or $194.50. Service of process will be about $50 more. While it is certainly lawful to proceed without a lawyer, I believe that in almost all cases it's a worthwhile investment in having someone who knows his or her way around the courts i.e. knowing how judicial officers are likely to rule on a given question and in general removing some of the burden and stress from the client. If you truly desire agree for an uncontested divorce, you can do it yourself by going to your local Courthouse and getting a Family Law Divorce packet from the Court Clerk. The packet comes with instructions that are easy to follow. The costs is minimal. Good luck.

Uncontested alone is not enough information. If you have children, there are still certain things that must be done (Parenting Plan, Coparenting class, etc.). Some lawyers will do a limited representation for around $500-$1000. You can review the Self Help forms on the Nebraska Supreme Court web site to see about doing it yourself. Best wishes!
