QUESTION

How much longer do I have to pay support?

Asked on Feb 08th, 2014 on Child Custody - Rhode Island
More details to this question:
My ex-wife moved and is home schooling my son. She broke a court order by doing so. She has done this before and I have paid to file contempt charges and nothing ever happens to her. I haven't seen my son in 2 years. I can't afford to keep going to court to see no results. My son is 16 now and I've tried contacting him and he won't respond. I give up. She has applied for increase in support now claiming I'm not paying health insurance which I do and cost of living increase. She lives at home with her parents now with another child to another man.

There are no cost of living increases in child support. Seeing your son has nothing to do with paying support. You have to pay until he turns 18 or graduates from high school. If the court ordered her not to home school and she is doing so and you can show this is harmful to the child, you need to make a motion for contempt with a clear cut order to enroll the child in school withing 3 days of the date of the order. Motions for contempt often fail because they are not well done and fail to actually make an argument showing contempt. The fact that she lives with her parents or another man is really irrelevant.

You have to pay support until your child reaches legal age, which is 19 in Nebraska. You are going to have to go to Court if she has sued you for an increase in support so you should file Motion relative to seeing your child.

Since you are having to back to court anyway you might as well file a motion to enforce and get attorney fees when you prove her violations. Child support is payable until the child reaches 18 years or graduates (which ever is later).

I don't know. Have you used an attorney for the contempt motions? Did you file them timely? Did the attorney explain why you lost? Regardless, in Idaho child support is due until the later of the child turning 18, graduating high school or turns 19.
