My youngest child is 18 and graduates from high school on June 6th. I have been paying $600 per month child support. My support orders say my payments are "payable in full on the first of each and every month, and continuing ... until the minor child dies, marries, or is otherwise emancipated; reaches the age of eighteen and is no longer a full-time high school student, or the age of nineteen, whichever first occurs... For my last payment in June, do I have to pay $600, or just the pro-rated amount for 6 days out of the month?
You June payment would be the entire $600.00 for the month. Is there a wage assignment or are you paying the support directly? If by wage assignment then it is possible that the order for the wage assignment includes the presumptive termination date of the support. You can check with your employer. If there is no presumptive termination date then you may need to file with the court to have the support terminated. You should consult with experienced family law counsel to review this issue.
It depends on how you pay child support. If you pay the money directly to the custodial parent, feel free to be a cheapo and send a prorated amount. It will then be up to the custodial parent to decide if it is worth the hassle to make you pony up the remainder that you owe. If you make your payments through some child support enforcement agency, they will most likely automatically show cause you if you only pay a prorated amount and not the full amount as ordered by the first. But seriously? Just pay the $600 be be glad that's the last payment.
