QUESTION

How should I handle this custody issue?

Asked on Feb 26th, 2017 on Child Custody - Pennsylvania
More details to this question:
My son's father and I came to an agreement outside of court and it is not documented. Tomorrow he is supposed to get him for two hours. It was brought to my attention that a constable and sheriff were at his last place of residence looking for him two times this week, I'm unsure of the reason. He also has an assault charge from the first of the year that I just learned about. Am I able to not allow visits until this situation is resolved? I feel uncomfortable having my son in a situation that could potentially become hazardous.

it sounds like you have primary physical custody  (h'es in your physical care more than 50% of the time) of your child.  If you do, it is your responsiblity to protect his best interests.  I cannot give you specific legal advice about what to do because i am not your attorney.  Whatever you choose to do, make certain that you are properly caring for your child, and also that you are not violating any court orders. If you think that the time has come to obtain a formal custody order from the court, then you have to file a Complaint with the court in the county where you live. Best of Luck.
