How to get married when ex husband is dead?

I want to get re married but I don't have divorce papers and he is no longer living. How can I get married?

If you are a widow there is no need for a divorce decree, and that would be true in any state in the United States.

Your husband's death terminates your marriage and leaves you free to remarry. You need only be able to prove his death.

Marriage terminates on the death of either party. If your prior husband is dead you are free to marry again regardless of whether the earlier divorce was ever finalized. Good luck.

Marriage terminates upon the death of one spouse. If I understand your question correctly, then even if your divorce was not finalized, you became free to remarry upon the death of your former spouse.

If your former husband is deceased there should be no issue in getting remarried. You probably should obtain a copy of the death certificate from the County where he died. You might want to consult a probate attorney or family law attorney or ideally someone with experience in both such as myself.
