QUESTION

How to separate when he wont leave my home

Asked on Dec 02nd, 2012 on Divorce - North Carolina
More details to this question:
I married in March of 2012. I now want to separate in order to get divorce. My husband refuses to leave my home which was acquired in 2007 before marriage. I can not leave as the loan and title are in my name alone, and I have a financial obligation on the house. I do I go about getting him to leave the house so that separation can begin?

You have several options.   One is to try to negotiate an agreement with one of the key terms granting you possession of the residence.  You can schedule a mediation before separation.   If you and the other party have a child together, you can file a lawsuit for custody before you separate.

This response does not establish an attorney-client relationship nor is it an acceptable substitute for seeking legal advice.
