Husband left

More details to this question:
My husband and I are nit getting along and he is staying with his parents or somewhere other than our home. I own my home and it is pre marital property. What rights does he have to the house or contents and can I require that I be present for him to come in the home? We are still married and no divorce paperwork has been initiated.

He may have some rights depending upon how long you were married, how bills were paid, and what increase in equity there has been during the marriage. If you want an order that he can only come back with you there, you will need to file for divorce (or something similar) and ask for a Court order. Good Luck.
