I have a 16 year old daughter that my ex wife has custody of. It was a non contested divorce. This was 3+ years ago.

My daughter has decided she would like to live with me now. Nothing is driving this at home with her mom at all. She likes spending time with me and want to spend a few years of her teen life with me. What would need to be done to make this so. I am more than personally and financially capable of taking care of her. Does she have any say in this matter? (My daughter)
There is case law in SC that does not hold in high regard a six year old's desire to choose where they live but that a sixteen year old's will be considered. It is, however, one factor among many. If her mother will not listen, and your daughter truly does want to move for adequate reasons you may wish to consult with an attorney to modify your original order.
