I am sorry to hear about your problems, and your current situation.
You are facing a jurisdicational dilemma. You really should not take the child, without permission from your husband. To do so could leave you looking very badly before the court.
From what you say, you can file in Utah. There is no way anyone can make you stay in Utah; but, the court may require that the child stay here.
Overall, it really makes no difference who files first. There no longer is the "race to the courthouse".
What you really need to do is find an attorney you can work with. An experienced attorney who can answer your questions, and fully represent you and your fears and concerns.
