QUESTION

I need help with a divorce.

More details to this question:
After 31 years of marriage in June 2021, my wife decided arbitrarily that she no longer wanted to have intimate relations. Three months later (September), she abandoned our home, moved in with our daughter, and eventually bought a house with her in November. She has fought me over paying the bills in our house (where I currently live) that she helped run up ($18k in credit card debt). She and our daughter have also run up about $30k in other credit card debt (on my cards) since she left (I have it all documented). We briefly tried marriage counseling with me going in good faith that she would be willing to compromise; but unfortunately, she is completely unwilling to give an inch, basically saying her way or no way. The house that she and our daughter purchased is more than they can afford, and they are slowly losing ground on their debt. I need to find a way to guarantee they will not leave me hanging with $40k+ in debt they spent, even if they declare bankruptcy.

Hi John, You are correct, you definitely need help with a divorce! The situation as you've described it is one that could go from bad to worse if you do not seek the help of an attorney quickly. Not only do married couples (typically) share an interest in property acquired during a marriage, but also in debts. You could be provided some protection upon the filing of a divorce with the automatic issuance of the statutory injunction, but aside from that you will most likely need the court to enter a temporary order to calm things down during the divorce proceedings. If you haven't already, you need to contact a local divorce attorney to help you with your particular situation.
