Ok so first of all this is my 3rd CPS case with my 3 year old son and its very unfortunate but the first one was ruled out because my son had a diaper rash because he has eczema and the daycare called but it was ruled out a few days later. Second time I was at a friends and we were drinking and having a barbeque and I went out to my car with my son because he wanted to go with me and the cops had showed up for a noise complaint, didnt even give me a sobriety test took me in for a Public Intoxication and they called CPS on me for a 2nd time, Saying it was neglectful supervision which is total bull Now this 3rd time was a really bogus call!! Someone called and made up some crazy things about me and false allegations. I have my life together and would do anything for my son hes my world. I work full time and getting my bachelors degree and drink only on few occasions. but once CPS has been called it seems like they will never go away and its scaring me to death. I voluntarily put myself on a waiting list for a 28 day inpatient alcohol treatment program, thats how serious I am. Im going to never take a sip of alcohol again!! its not worth all of this. so anyway my son has been staying with his father over at his aunts house for the past few nights and next week CPS wants both of our families to come together and make a plan for my son to stay with his Aunt for 1-3 months. Only problem is, his aunt, her husband and 4 kids are living in an extended stay until there house in ready at the beginningto middle of August, so im afraid they will say that's not a stable place for him to be, and Shes the ONLY option. I My fiance is telling me not to talk to CPS until we get a lawyer. i feel like they can just take him at anytime, im so scared. But my boyfriend and his family say that the judge wont sign a removal if CPS doesnt have proof of neglect or abuse. I feel like there attacking me and my family and I dont know my rights. i need some insight please!!
You are correct, you do need a lawyer. CPS is very difficult to deal with and it is even more difficult in some jurisdictions. The danger you face is that if there is no approved placement for your son he can be placed with a foster family or kept in a juvenile facility. Your attorney should get an alternative evaluation that shows (if possible) that the placement you favor is safe. Talk to the attorney that you choose about trying the public intoxication case if it is not too late. If you have already pled guilty and got a probation or a conviction, see about a motion for new trial if the time limits have not run. Whatever you do, it is important to act quickly.
