hello there i have a question. My sister is an alcoholic and lives with her boyfriend who is also an alcoholic. My sister has an 11 year old who lives with them. The child started saying that she is scared and not safe at the house with all the yelling a drunken fights.. and that my sisters boyfriend yells at devan ( the child) and calls her horrible names and tried to break into her room with a knife when he is drunk. she said she wanted to run away or kill herself because she is so upset with her home situation. My parents are very wealthy and we as a family called the cops on my sister and CPS (child protective services), they agreed to let Devan stay with my parents till Thursday and then reevaluate the situation. I was wondering if it is possible to get a restraining order on the boyfriend for Devan to help prevent her from being forced to go back to the home

       Your sister can apply for a restraining order against her boyfriend, depending on the facts and circumstances involved, either for harassment or domestic abuse. The biological father would also have standing to file a motion with the court either to request custody of the minor child, or to file some type of an order against the mother to keep her boyfriend away from the child. In the meantime, since apparently child protective services has been called in, it would be best just to let them handle the investigation and presuambly make appropriate recommendations to the court if necessary, regading your nephew's placement.
