I had to move in back with my mom till I got back on my feet and well its only a two bedroom and me and my kids don't actually have a room here but they have everything they need and are safe. Can he use this against me in court because they don't have a room to call there own here

The answer depends on the age of the children and living conditions. The problem is worse if they are not the same sex. The court will look at the living conditions in your home and those of the other parent and make a choice.
