If he cannot physically take care of our daughter doesn't that mean that I should have her?

More details to this question:
My daughter's father has primary physical custody of our daughter and we share legal but he is unstable and also has been incarcerated throughout her entire life for drug charges and duis. Ex: Since he's in jail he can't take care of her so can I just take her ?

You should probably get a lawyer and do it through motions court so you have a Court Order granting you physical custody until he gets out of the pokey.
