In the State of Louisiana, can my 18 year old daughter (who is entering the 11th a grade,) decide to live with her father when she was court ordered to live with her mother 8 yrs. ago? It is my understanding that in Louisiana Revised Statutes 9:315.22(C) child support shall continue but the primary domiciliary parent is the proper party to enforce an award of child support pursuant to this Subsection. It does not state anything about the child having the authority to make her own decision in where she wants to live.
Even though child support may continue until age 19, your daughter is legally an adult upon reaching age 18. Thus, the decision is hers concerning where she'll live.
