QUESTION

Is a notarized custody agreement legally binding?

Asked on Oct 06th, 2014 on Child Custody - Ohio
More details to this question:
My boyfriend and his ex are agreeing on letting my boyfriend take over custody of their son. My boyfriend is under the impression that a notarized shared parenting agreement is sufficient. Would it be legally enforceable and would it prevent her from continuing to get child support from him if they both sign an agreement in front of a notary?

In a word: No, Changes in custody are the responsibility of the juvenile court in cases where parents are not married. Your boyfriend cannot bypass the court. To do the job right he must establish paternity and then seek a modification of custody and visitation. Have him see a family law professional. His child is worth the effort.
