I live in MA and plan to divorce my husband. He has been working under the table and has not paid taxes for years as he was an illegal immigrant. He just gained status following our marriage. However, is income is not documented. I make substantially more then he. My salary is $100000. His yearly salary is at $35000 (not paid taxes). I do have emails dating back throughout our marriage discussing his payments under the table and he refusing to report per my request. He and I have been married for 31 months. We are divorcing because once we married he stopped being intimate and things have not changed. My question is: will I pay alimony to him? How much approximately and for how long? Lastly, how can I prove he has been making money under the table.

Alimony is based on need and is limited to 30% to 35% of the difference in the parties income. The durational period for marriages under 5 years is 50% of the months married. Your requirement to pay alimony will be based on his need. The emails and an analysis of his expenses can prove his under the table income.
