Asked on Jul 26th, 2016 on Child Support - New Jersey
More details to this question:
I have 4 kids and currently pay $1300 a month in child support. This amount was based on my 3 year avg salary of $156,000 and my ex's salary of $195,000. Immediately after the divorce, my ex got a new job and started making big ticket purchases - new car, $20,000 in home improvements, multiple first class flights, etc. She pays $6,000 a month for her mortgage and there is no way she can manage that mortgage with all of the spending she has been doing. I asked her for her 2015 information as well as a 2016 paystub as I believe her salary increased by $100,000. She has refused. My salary has suffered since the divorce and I barely have enough to get by on after I pay the child support.
I have seen your question.
My name is David Salvaggio. I have more than 35 years of legal experience and head a law firm that devotes its practice exclusively to New Jersey Divorce and Family Law matters. Please feel free to take a look at our Firm Website (www.salvaggiolaw.com) for further information about my firm.
In New Jersey, a person who wants a child support modification must demonstrate to the Court that there have been sufficient "changed circumstances" that justify the modification. Because each application is decided on its own unique facts and there is no "formula" in New Jersey for determining when that has happened, a good lawyer will not be able to answer your question without first meeting with you and getting a lot more facts.
Your question does not specify the town in which you live. My firm's offices are located in Morristown, NJ (Morris County). We handle cases in all of the counties in northern and central New Jersey, including not only Morris County but also Somerset, Hunterdon, Sussex, Warren, Passaic, Bergen, Hudson, Middlesex and Monmouth counties.
If you live in one of those counties, please call my office (973-455-1220) and speak to the firm’s Client Intake Coordinator Dara Vanderhoof. I will be happy to have a brief phone call with you--at no charge of course--to get more facts.
