Yes it should still be possible - especially since there are reasons why the support was not paid. The court does not make a direct connection between the payment of child support and the care and custody of a child. Although sometimes non-payment of child support can be used as evidence of a lack of interest in the child's well-being - but not in your case, I think. There are a lot of factors that a court must consider in order to change the physical care of a child and I can't predict what the outcome might be without knowing more about your situation. But the fact that you may be or have been behind in child support shouldn't play a big part in the decision. The more important issue is the relationship between father and child, so I would urge your husband to spend as much time as he can with the child.
