QUESTION

Is it reasonable to have the child support changed?

Asked on Jan 20th, 2015 on Child Custody - Wisconsin
More details to this question:
We live in Wisconsin and my husband has 50/50 custody of his daughter but because both my husband and his ex have SSDI as their income they put her under one of the parent’s claims. Because of the fact that my husband qualified for more income for her she was put under his case and he paid about half that to her mom in child support. Now that we have another child and one on the way the amount that he got for his daughter changed to less. Is it reasonable that he should only have to pay half of what he gets for her now to her mother?

On the facts you stated, your husband probably loses, unless there are other changes in circumstances. Under the rules for 'serial' payors, first child gets 17% (usually); child from different mother born later gets 17% of what's left that is 17% of 83%. You would do well to consult a lawyer experienced in these matters. Good Luck.
