Is it wrong to keep my money

More details to this question:
I gave an attorney a deposit to start a divorce but was told nothing would be filed or started until the required amount at half the cost was met .now the other party aquired legal aid services and all I have to do is sign there's no property or children I called the attorney and she very rudely said she's not giving me the money back that was for her time she didn't file anything only took my money ,first consultation is free is this ethical besides how very rude she was and hing up on me saying I'm not arguing with you ?

Was there a written fee agreement? There should have been detailing whether the money was non-refundable or not. You may have to sue the attorney at the magistrate to recoup the fees.
