QUESTION

Is there a way I can secure a residence without notifying my spouse?

Asked on Feb 09th, 2015 on Divorce - Florida
More details to this question:
I'm homeless and want to buy a property to live in, but I have learned that I have to notify my spouse and have them on the deed or mortgage which is a violation of my safety. What are the loopholes in which I can secure a residence if I'm on SSDI and low income that will not involve or notify my spouse?

If you qualify for a loan, ON YOUR OWN, you can purchase a property under your name only, HOWEVER, if you did that, your spouse could later claim you used marital monies for the down payment and marital monies for the monthly payments and therefore claim her marital interest in the home. It is a risk that you need to think about carefully. Good luck.

You are separated from the spouse, right? I guess the best way to do it is to file for divorce and then purchase a home.
