More details to this question:
I am going to court wednesday for custody and visitation. My daughter has lived with me all her life and her father has lived in texas since she was 7 months old she is now 2. I filed for visitation and custody due to threats he has made of taking her from me, but he has no way of doing that I am not unfit. So I filed for physical custody and visitation so he can see her, but I do not want to send her to Texas for visitation. I don't mind him seeing her but I want him to see her in new jersey not him take her to texas. I believe she is too young to travel back and forth across the country. And I believe since he hasn't done his part as far as helping take care of her I would like visitation to be in new jersey where she resides with me.
A this very young age, it is not uncommon that visitation be limited to New Jersey, that you would not be expected to allow the child to to Texas, especially since the New Jersey court does not have jurisdiction in Texas. Your ex would have to apply to the New ejrsey court for permission to take your daughter out of the state.
