QUESTION
Is this enough to dismiss a Final Restraining Order?
Asked on Dec 25th, 2014 on Domestic Violence - New Jersey
More details to this question:
My fiancé's aunt was granted a restraining order against him in July of this year. He has complied with it ever since; no violations, no nothing. She on the other hand has had his other relatives transmit messages from her in the past, has been caught and reported for stealing his SSDI twice (she is his representative payee, which we are working on changing), and is now contacting him directly via email. He would be immediately arrested were he to engage in any of this behavior. I have intercepted emails from her to him on two occasions: on 12/7 and 12/25. When I went behind his back on 12/7 to contact her and tell her to leave us alone, she demanded a direct response from him. Do we have a case for dismissing her restraining order?
