Joint custody- different states.

More details to this question:
Hello, I have a 3 year old son and my sons father has always lived 2 floors up from me. We are not together. Due to me being unemployed until this year and honestly being unstable my son had been staying with him since we split. I am now employed I make more than my sons father ( I'm only stating because maybe it helps ). Ever since I started working Ive helped pay for half of his daycare and etc... he has now decided to move to NJ and is demanding he is taking him with him. I have also started a search for my own place.. what are the chances of my son staying with me? I just want what's best for him, his father is a great father, my best intrested is in my son and also me. Seems unfair. What steps should I take? Thank you

You don't say when you split from the father- did you have custody before that? Whether or not you did, you can probably prevent the father from taking your son out of state. You have a right to be in your son's life, even if you don't win custody. The best way to work this out is to file a petiion seeking custody. The father won't be able to just take your son out of state without court approval if you file a petition.
