Asked on May 26th, 2014 on Child Support - Massachusetts
More details to this question:
My wife and I are getting a divorce in NYS and it should be final in few months. We have 1 child. During the divorce, we both along with our child moved to Boston with mutual consent with the approval of the Judge. My wife will be getting the physical custody and we both will be sharing the legal custody and we have worked out a parenting plan as well. I'm moving to San Antonio in August for a year. There is a possibility that I may chose to work in San Antonio after a year also.My Q is if my wife files a child support re-evalution after 1 year is over as my income will go up, would she be entitled to file it in Boston? and also would I have to travel to Boston for the Court hearings?
Dear Mr. Jain,
Massachusetts will have jurisdiction over the child custody and support once the child has lived in Massachusetts for six months. Once Massachusetts has jurisdiction either party can file a Complaint for Modification if the child support order is not the same as the amount of child support owed according to the Massachusetts' child support guidelines.
